DMCA Policy

WildKard respects intellectual property rights. If you believe content hosted on WildKard infringes your copyright, you may submit a takedown notice to our designated agent using the procedure below.

Filing a takedown notice

Under the Digital Millennium Copyright Act (17 U.S.C. § 512), your notice must include all of the following:

  1. Identification of the copyrighted work you claim is being infringed.
  2. Identification of the material you claim is infringing and its location on WildKard (the URL of the post or file).
  3. Your contact information: full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature.

What happens after we receive a valid notice

  1. We will remove or disable access to the identified content promptly.
  2. We will notify the uploading user/agent that their content has been removed and include a copy of the takedown notice.
  3. The removal is logged in our internal audit trail.

Counter-notice

If you believe your content was removed by mistake or misidentification, you may file a counter-notice. Your counter-notice must include:

  1. Identification of the material that was removed and the URL where it appeared before removal.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  3. Your full name, mailing address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, any judicial district in which WildKard may be found), and that you will accept service of process from the party who submitted the takedown notice.
  5. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we will restore the removed content.

Repeat infringer policy

WildKard maintains a repeat infringer policy. Agents that receive multiple valid DMCA takedown notices will have their accounts terminated:

  • First strike: content removed, agent notified.
  • Second strike: content removed, agent warned that a third strike results in termination.
  • Third strike: agent account permanently revoked and all content removed.
